Dick’s Sporting Goods’ (“DICK’S”) Launch Reservation Program (the “PROGRAM”) was created to combat automated BOTS, to provide DICK’S customers an equal chance to purchase rare items for which demand may exceed supply. The following Terms & Conditions (“Terms”) apply to all purchases made or attempted to be made for items sold through the PROGRAM (each, a “Product”). Failure to comply with these Terms may result in disqualification, including from future PROGRAM events.
Entry is solely for the opportunity to purchase the specified Product, for the listed price, at the entrant’s own expense (the “Purchase Opportunity”). The Purchase Opportunity has no cash value, and no other prize is given to entrants who are selected. No purchase is necessary to enter. A purchase or payment of any kind will not increase your chances of being eligible to purchase the featured product. Void where prohibited. Sponsor (defined below) reserves the right to cancel winning entries for any reason.
OVERVIEW: The Program and each PROGRAM event is (a) governed by these Terms, Sponsor’s Terms of Use, and Privacy Policy (together, the “Policies”); (b) void where prohibited or restricted by law, and (c) subject to all applicable federal, state, and local laws and regulations. Eligibility is conditioned on the acceptance of all of the Policies at the time of entry, but exercising any opt-out rights within the Policies will not impact eligibility.
ELIGIBILITY: Each PROGRAM event is open only to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry and have a valid ScoreCard account. If you aren't a ScoreCard Member, you can create a profile during registration. Membership is free. You must have the DICK’S Sporting Goods mobile app, a valid credit card, access to the Internet, and a valid email address in order to enter.
Employees of Sponsor, participating vendors (if any), their respective parent companies, affiliates, and subsidiaries, and their respective participating advertising, sweepstakes, and public relations agencies, as well as members of their families and/or those living in the same household as such individuals, are not eligible to enter.
HOW TO REGISTER: Open the DICK’S Sporting Goods mobile app, make sure that you are signed into your ScoreCard account and review the FAQ page found here for details on how to register. There is a limit of one (1) registration per person, per PROGRAM event. You will need to provide your billing address (and shipping address if it is different) and credit card details (other methods of payment are not permitted). If you submit a new credit card not previously used to place an order from DicksSportingGoods.com, your credit card will be authorized for $0 at the time of placing the entry. You will only be charged the cost of the Product (plus tax and shipping) if and when your entry has been selected and you have been notified via email, at which point your payment will be captured.
By submitting payment information, you represent and warrant that all such information is accurate, and if you are selected as a winner, you authorize DICK’S to place an order using your credit card for the full price of the Product plus, if applicable, charges for tax, shipping and handling. If you are selected as a winner, you will be automatically charged for the Product, and will not be able to exchange your order. DICK’S is not responsible or liable for inaccurate information or information that later becomes outdated, and has no obligation to make efforts to determine the correct contact or shipping information. Please note that the delivery address cannot be changed later.
Each PROGRAM event has its own entry period (“Entry Period”), which is specified on the page for the given event. All entries must be submitted during the Entry Period. Use of any automated system to participate is prohibited and will result in disqualification from the PROGRAM, the PROGRAM event and all future PROGRAM events. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, all of which are void.
ONLY ONE ENTRY PER PERSON, FAMILY, OR HOUSEHOLD IS PERMITTED. SUBSEQUENT ENTRIES WILL BE VOID AND ARE GROUNDS FOR DISQUALIFICATION OF ALL PRESENT AND FUTURE ENTRIES FOR ANY PROGRAM EVENT.
RANDOM WINNER SELECTION: A designated number of winners (depending on the inventory of each size and style of the Product) will be randomly selected from all eligible entries received from verified account holders during the Entry Period. Winner selection will be conducted by Sponsor, or Sponsor’s representative or designee. The odds of receiving eligibility to purchase the Product depends on the number of eligible entries received during the Entry Period, and the amount of inventory received in each Product size and style. The decisions of Sponsor are final and binding on all matters relating to the PROGRAM and PROGRAM events.
Both winning and non-winning entrants will be notified by email (at the Sponsor's discretion) within approximately twenty-four (24) hours after they are selected. If an entrant has violated any of these Terms, then an alternative entrant may be selected, at the Sponsor's discretion.
THE PURCHASE OPPORTUNITY: Winners will not receive anything other than eligibility to purchase the Product at the listed price, at their own expense. No cash value is associated with the Purchase Opportunity. No coupons, reward points, gift cards or discounts may be used for purchase of shoes. Each winner shall be responsible for all sales tax associated with the purchase of the Product. No Purchase Opportunity substitutions or cash redemptions allowed, except by Sponsor, who may substitute the Purchase Opportunity in its discretion if the Product becomes unavailable. Purchase Opportunity is not transferable. Sponsor does not guarantee or warrant that every winning entry for launch shoes will be fulfilled. The Product is not eligible for exchange.
PAYMENT: If you win, your credit card will be automatically charged for the price of the Product plus, if applicable, charges for tax, shipping and handling. The order is automatically placed after winning, you'll receive an order confirmation email with your purchase details, finalizing the sale. The purchase of the Product is governed by Sponsor’s Terms of Use.
If you're not selected, the initial credit card authorization will be released and you won't be able to purchase the Product. The amount of time for the initial authorization to be removed from your payment method may vary depending on your bank.
Sponsor is not responsible for any failed transactions including card issuer error codes or insufficient balances; such orders will be canceled. Sponsor is also not responsible for any orders that are returned as undeliverable or redirected to a different address once it has shipped.
CONDITIONS OF PARTICIPATION: Parent/Guardian permission is required for entrants over the age of 18 if, in their state of residence, the age of majority is older than age 18. Sponsor shall not be held responsible for any delays in awarding the Purchase Opportunity or any component thereof for any reason. In the event that the winner is found ineligible or to not comply with these Terms, the Purchase Opportunity may, in the Sponsor’s sole and absolute discretion, be forfeited and, in Sponsor’s sole discretion, awarded to an alternate winner selected at random from the remaining eligible Submissions. Failure by the Sponsor to enforce any provision of these Terms shall not constitute a waiver of that provision.
RELEASE: By participating in the PROGRAM, each winner agrees to release Sponsor, participating vendors (if any), and each of their respective parent companies, subsidiaries, affiliates, related companies, and advertising, promotion, and public relations agencies, and each of their respective officers, directors, employees, and agents (“Released Parties”), from any and all liability, loss or damage of any kind arising out of or in connection with their participation in the PROGRAM, or with respect to awarding, receipt, possession, use and/or misuse of any Purchase Opportunity. The Released Parties are not responsible for any typographical or other error in the printing of the offer, administration of the PROGRAM, or in the announcement of the prize. An entrant may be prohibited from participating in the PROGRAM if, at Sponsor’s sole discretion, if Sponsor reasonably believes that the entrant has attempted to undermine the legitimate operation of the PROGRAM by cheating, deception, or other unfair playing practices, or annoys, abuses, threatens, or harasses any other entrants, Released Parties, or associated agencies or entities.
DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the PROGRAM, or any Purchase Opportunity awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Pennsylvania. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the PROGRAM, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law or conflict of law rules (whether of the Commonwealth of Pennsylvania or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.
ELIMINATION: Any false information provided within the context of the PROGRAM by any entrant concerning identity, postal address, telephone number, ownership of right, or noncompliance with these Terms, or the like, may result in the immediate elimination of the entrant from the PROGRAM, PROGRAM event and the barring of the entrant from all future PROGRAM events.
WAIVER: Entrants hereby waive all rights to: (i) claim punitive, exemplary, special, incidental, indirect, consequential damages, and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket costs; and (ii) have damages multiplied or otherwise increased.
LIMIT OF LIABILITY: If, for any reason, the PROGRAM or a PROGRAM event is not capable of running as planned, including infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, pandemic, act of God, or any other causes which corrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of the PROGRAM or PROGRAM event, Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the PROGRAM and/or PROGRAM event, or any portion thereof at any time, and for any reason without further obligation or advance notice. Sponsor reserves the right, but does not have any obligation, to select winners from eligible entries received as of the termination date and time. Sponsor further reserves the right to disqualify from PROGRAM and PROGRAM event, and all future PROGRAM events, any individual who tampers with the entry process, or the operation of the PROGRAM and/or PROGRAM event, or acts in violation of these Terms, or in an unsportsmanlike or disruptive manner.
SEVERABILITY: If any provision(s) of these Terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
